Disappointed Neil Diamond fans will get a refund after attending a concert at Ohio State University in which the 67-year-old singer's voice sounded raspy. ADVERTISEMENT

Some fans left the Monday concert early and others said Diamond completed the concert without mentioning anything to the audience about his voice.

A statement from Diamond, the singer of such hits as "Sweet Caroline" and "Song Sung Blue," on Tuesday says a doctor has diagnosed acute laryngitis.

Diamond spokeswoman Eve Samuels says the singer is offering a refund to those who place a request before Sept. 5. "I haven't let you down before and I won't let you down now," the singer said in an apology on his Web site.

Another message says Wednesday's concert in Green Bay, Wis., will be rescheduled for Sept. 12, and Friday's concert in St. Louis, Mo., will instead take place Sept. 10.

THE FACT THAT YOU ENDORSE "AVID" AND CHOOSE TO NOT GIVE THE REAL MEANING BEHIND AVID SHOWS YOU FOR WHAT YOU ARE.

AVID IS A DISCRIMINATORY ACT THAT EVEN THE FOUNDER OF AVID KNEW WOULDNT FLY WELL AND IT WAS SNUCK INTO THE SCHOOL SYSTEMS.
IF YOU DOUBT THAT THEN LOOK IT UP.

you used the term "innate."

IF ITS INNATE, AS YOU SAY , THEN WHY A SPECIAL CLASS.
LET THAT "INNATENESS" DO ITS THING.

EQUAILTY IS NOT ACHIEVED THROUGH SPECIAL TREATMENT METHODS.
THAT ONLY FOSTERS REVENGE

<At issue is whether it's morally justifiable to define an "Abercrombie look" these days, three years after a lawsuit settlement forced the retailer to enhance diversity>

<  "There's no real problem to discriminate against 'ugly' people," said Jahan Sagafi, a partner at Lieff Cabraser Heimann & Bernstein, the firm that represented the plaintiffs in the original diversity suit. "The problem is when you define beauty to incorporate white, which it essentially does at Abercrombie."

Ms. Carmichael and Mr. Payne are both white and say they don't expect legal or financial compensation.>

< The company agreed in 2005 to pay $40 million to a group of Latinos, blacks, Asians and females who accused the company of advancing whites at the expense of minorities

The Analysis:

The company WILL NOT JUDGE ANY RACE OTHER THAN WHITES ( interesting that both whites said they wouldnt sue) as they will fear more lawsuits to come from any minority employee

So then it will only (mostly?) be white employees that are targeted for this LEGAL practice

One worker caught in Monday's sweep at the Howard Industries transformer plant said fellow workers applauded as immigrants were taken into custody. Federal officials said a tip from a union member prompted them to start investigating several years ago

In a statement to the Laurel Leader-Call newspaper, Howard Industries said the company "runs every check allowed to ascertain the immigration status of all applicants for its jobs."

"It is company policy that it hires only U.S. citizens and legal immigrants," the statement said.

IF THEY WERE PAYING THE ILLEGALS LESS THAN THE OTHERS THAN THE COMPANY KNEW THEY WERE ILLEGALS

LPGA to require English for intl players

ORLANDO, Fla. (AP)—The LPGA Tour boasts players from all over the world, and it wants all of them to be able to speak English.

The LPGA will require players to speak English starting in 2009, with players who have been LPGA members for two years facing suspension if they can’t pass an oral evaluation of English skills. The rule is effective immediately for new players.

“Why now? Athletes now have more responsibilities and we want to help their professional development,” deputy commissioner Libba Galloway told The Associated Press. “There are more fans, more media and more sponsors. We want to help our athletes as best we can succeed off the golf course as well as on it.”

The tour held a mandatory meeting with South Koreans last Wednesday at the Safeway Classic to inform them of the new policy, which was first reported by Golfweek magazine.

There are 121 international players from 26 countries on the LPGA Tour, including 45 players from South Korea.

The South Koreans were informed of the rule, however LPGA commissioner Carolyn Bivens has not given them—or anyone—a written explanation, Galloway said

A man who wrote hundreds of hateful letters to black and mixed race men _ including Supreme Court Justice Clarence Thomas and New York Yankees shortstop Derek Jeter _ was sentenced Tuesday to three years and 10 months in prison.

Authorities said the boy, whose name is not being released because of his age, stabbed 14-year-old Keith Dancer in the heart with a steak knife during a dispute.

Mayfield told the youth that if he continues to show good behavior, he could be released on parole in three years.

ALSO THEY TELL THE NAME OF THE VICTIM WHO IS UNDERAGED, BUT NOT THE SUSPECT

NEW HAVEN, Conn. (AP) -- Nine-year-old Jericho Scott is a good baseball player - too good, it turns out.

The right-hander has a fastball that tops out at about 40 mph. He throws so hard that the Youth Baseball League of New Haven told his coach that the boy could not pitch any more. When Jericho took the mound anyway last week, the opposing team forfeited the game, packed its gear and left, his coach said.

But Vidro says he didn't quit and the team refuses to disband. Players and parents held a protest at the league's field on Saturday urging the league to let Jericho pitch.

"He's never hurt any one," Vidro said. "He's on target all the time. How can you punish a kid for being too good?"

The controversy bothers Jericho, who says he misses pitching.

"I feel sad," he said. "I feel like it's all my fault nobody could play."

Jericho's coach and parents say the boy is being unfairly targeted because he turned down an invitation to join the defending league champion, which is sponsored by an employer of one of the league's administrators.

Jericho instead joined a team sponsored by Will Power Fitness. The team was 8-0 and on its way to the playoffs when Jericho was banned from pitching.

"I think it's discouraging when you're telling a 9-year-old you're too good at something," said his mother, Nicole Scott. "The whole objective in life is to find something you're good at and stick with it. I'd rather he spend all his time on the baseball field than idolizing someone standing on the street corner."

League attorney Peter Noble says the only factor in banning Jericho from the mound is his pitches are just too fast.

"He is a very skilled player, a very hard thrower," Noble said. "There are a lot of beginners. This is not a high-powered league. This is a developmental league whose main purpose is to promote the sport."

Noble acknowledged that Jericho had not beaned any batters in the co-ed league of 8- to 10-year-olds, but say parents expressed safety concerns.

"Facing that kind of speed" is frighteneing for beginning players, Noble said.

League officials say they first told Vidro that the boy could not pitch after a game on Aug. 13. Jericho played second base the next game on Aug. 16. But when he took the mound Wednesday, the other team walked off and a forfeit was called.

League officials say Jericho's mother became irate, threatening them and vowing to get the league shut down.

"I have never seen behavior of a parent like the behavior Jericho's mother exhibited Wednesday night," Noble said.

Scott denies threatening any one, but said she did call the police.

League officials suggested that Jericho play other positions, or pitch against older players or in a different league.

Local attorney John Williams was planning to meet with Jericho's parents Monday to discuss legal options.

"You don't have to be learned in the law to know in your heart that it's wrong," he said. "Now you have to be punished because you excel at something?"

GO AHEAD, LOWER THOSE EXPECTATIONS

Dallas public school students who flunk tests, blow off homework and miss assignment deadlines can make up the work without penalty, under new rules that have angered many teachers.

The new rules will be distributed when teachers return to their campuses next week. But many who have already seen the regulations say they are too lenient on slackers, and will come at the expense of kids who work hard.

For example, the new rules require teachers to accept late work and prevent them from penalizing students for missed deadlines.
