In a court of law, a person has to be found sane enough to understand the difference between right and wrong.

Well that is stupid. 

Think about it.  Does a sane person commit murder?

If someone really got you mad, do you kill him?

Of course not, because you are sane (most of you bloggers).

Therefore, if someone commits murder, they are insane. 

All murderers are insane. 

So is it a difference of degrees?

If you begin with the premise that the law is there to protect the innocent, then there should be a verdict, "Guilty by reason of Insanity."

We do not put them away to punish them, but to protect the innocent.

One other thing.  In Atlanta, someone held up a store and killed the Emory law student there.  His wife was pregnant.  They caught the guy and sent him to prison.

Now, I was innocent, but I have to pay for this pile of feces to live in prison, (about $200,000 ?) a year for life.

I want a choice. 

Kill the killer, one shot.

Then I pay the widow $40,000 for 5 years.  She has the baby, then goes back to school so she can support herself and her baby.

The loser never gets out on parole.

We save big bucks.

Great Post PW..

I’ve ALWAYS said that to have somebody on the street that had EVER been “ Innocent by reason of Insanity” was Itself INSANE..

I would rather stand next to a Mafia Hit man at a Bus Stop then someone who had commited a SERIOUS Crime and was deemed LEGALLY INSANE..At LEAST I would have HAD to DO something for the Hit Man to be after me..

And NOW that I think of it,, HOW come NOBODY’S ever been legally deemed “Innocent by reason of Insanity “ for shoplifting or car theft or for THAT matter,, ANY crime other then MURDER..

Hmmmmmm....

I always thought that law was for the mentally retarded or severely handicapped that truly do not know the difference between right and wrong.
The problem is, is that the courts have allowed so much grey area BS into the law that now anything can be construed as a mental defect.

I think they are not insane, they just have no regard for human life. They still know that it is wrong, otherwise they wouldnt try to hide their crime.

I don't think that she meant to say that ALL people who are insane don't know right from wrong..I think that SHE was critical of the premise that NOT knowing right from wrong is insane and a Legitimate defense..

For ME,, INSANITY is the LAST reason someone should be set free...

And HERE'S something ELSE..HOW is it that if they don't know right from wrong that they ALWAYS take the time to HIDE what they'vedone??
That tells ME something RIGHT there..

Like,,WE were supposed to IGNORE that Couey HID that little girl for a week and THEN buried his crime,, THEN think he's innocent by reason of insanity ( don't know right from wrong ) JUST because he's coloring in a book during his trial??

I watched a program on men on death row.
The one thing that came across loud and clear was that these men did not value their life.
If someone does not value their own life, then they do not value anyone elses.

Good Point: That so many hide the evidence of their crime is proof that they did know that they were doing wrong.

My point, that anyone who murders someone is insane, is that it is a given and, therefore, not a legitimate defense.

I'm all for that!!! But of course there are also defined reasons that makes a difference as well. Killing in self defence is one of them. There are some that have even been conficted and labled as a murderer. The justice system doesn't always work the way it should because of laws written and not completely covering certain circomstances. Laws can be twisted with the innocent as used as a defence for the truly quilty. A lot of women from abused marriages have even gone to prison for all the wrong reasons and yet they were victims and punished by the system. So it's really all on what really IS!

Another problem is the intentional misinterpretation and use of the law for personal and political reasons..Like those who get prosecuted for defending their homes,,etc..

THIS can be for reasons as Personal as the OPINION of the Prosecutor that guns SHOULD be illegal,,and SINCE they aren't,, he'll go ahead and prosecute it as though they were.. or as in the case of Nifong,,A bid to increase his Exposure for future political aspirations..

Funny I tryed to get that very point across with some of the blogs about guns. My blood pressure went up so high I had to stop blogging for a while because they just never got it but continued to argue the point! What the law may give you rights on can and will be taken away because of other opposing laws in which are inforced through the court system!

I am a portrait artist, kitchen designer, former teacher, and MOM of two incredible young adults. I feel that oil companies are destroying the country. I would like to see congress pass much higher milage requirements for all vehicles of locomotion. I would like to see the rail systems improve and ultimately reduce the 18 wheelers on the road. We need more alternative energy, and not ethanol; solar, wind, water. I would like to see illegal invaders go home. I would like to see all our men and women in the military come home. There is no reason Iraqi should not pay for their own defense. I would like to see it cost businesses to "outsource". I'd like to eliminate Capital Hill's Golden Fleece Pension and see all of the men and women on Capital Hill receive the same social security and health insurance that we get, then, just maybe they would get serious about saving it.
