Folks

You know Im no fan of HOAs

I know I got the deeds and all the rules before i bought etc

.

but can I legally get out of  it?

Ive had enough paying 900 bucks a year just to live somewhere and be told what i can and cannot do with my home that I am paying for...(I dont use the gym, pool, nature trail, tennis courts BB courts etc)

Heck, if sth carolina can do it -so can i ?

Or are HOAs just too darn powerful ....

 

on another note-IF im forced to live in a HOA then its time we all started to take the cities to task- after all If Oviedo  said NO to our wanting to be a gated community- and we live on CITY streets-shouldn't the CITY be cutting the common areas instead of me paying twice (city taxes and then HOA fee for landscaping)

 

I know i could have bought somewhere without HOAs but WHERE ? all new subdivisions have them.....and I liked the model....   :-(

I live in an area with a HOA and I tell them where to stick it.
The problem with HOA's is most people dont want to get involved and since they dont the ones in charge let the titles of their offices go to their heads(most of them never had a position of authority in their past).

Sure... just buy a home that does not have an HOA. Now Should you do that, I hope that we won't see anohter group of posts that complain about loud parties, broken down homes with fences and landscape in disrepair, 3 cars, boat, and an RV parked in the front yard, etc.

I too have "city streets" in my PRIVATE non-gated neighborhood, and they maintain the fire hydrants, and such.

Your message is confusing however. On one hand you don't like any govt. type regement (HOA) but yet you want the city to do all the other work. Gotta take the good with the bad my friend. Maybe a condo would be better for you.

You choose to give up your rights when you choose to live behind a gate , liking the “house” is a weak excuse you can buy the blue prints for just about anything and build it wherever you like ...many of us don't care what our neighbors are doing because we can't see them from our home! And sad but true you paid a lot more to live under a HOA than what the same house on a much larger piece of land would cost els where ....

Where I live may be out in the boonies but it's still listed as a sub! We have no HOA telling us crap. One guy thought he would try but it failed being he was alone with his own ideas. I would never buy any home where HOA's are inforced! It's just another expense of a political kind of control that I will never have any part of! Read your contract...does it give you an opt out position? I bet not!

My heart goes out to you FloridaBritt..GOSH I WISH I WOULD HAVE BEEN BETTER ADVISED.....what bunch OF CROCK..these HOA's..are...and needless to say I WAS A BOARD MEMBER FOR TWO YEARS.....I CAN'T BEGIN TO TELL YOU WHAT DISAPPOINTMENTS...in any event, THE ONLY WAY OUT....IS SELLL AND GET OUT....I will say this though I have a friend and a relative living in other parts of Central Florida and have HOA's BUT MY GOD......NOW, THAT'S WHAT I CALL SERVICE......so I HAVE EDUCATED MYSELF WELL FOR THE FUTURE.....but I after dealing with my friend's and relative HOA..THEIRS ARE ABOVE THE NORMAL......BUT THEN AGAIN, THEY PAID GOOD MONEY TO KEEP IT THAT WAY.........I feel like I am in cuba in some COMPOUND, AS MY HUBBY calls it, LOL...in Cuba every street has a FIDEL CASTRO REGIME MEMBER THAT REPORTS everything one does.......OH BOY...THIS IS NOT GOOD MEMORIES FOR ME.......LOL...good luck. ON ANOTHER NOTE, CALL THE BAR ASSOCIATION..there are plenty of HOA attorneys however, quite pricey but they will give you BETTER AND SOLID ADVICE........

For me I don't have a problem with it. I like knowing the dogs can't run loose, changing engines in the front yard taking all summer and jacking the truck up with tires and centerblocks isn't an option. I like not having every magazine, cookie, and religion salesman come to my door to feed, enteratain or save me! I'm glad I don't have the "Plastic Disney Land" in the yard of every other house faded by the sun and never played with. Thank God, my neighbor can't get a wild hair up his @$$ and paint his house purple or screaming pink! I'm glad my neighbor can't set his trash out in the direct sun at the driveway 3 or 4 days out from trash day! I'm glad there isn't the redneck above ground pool next door that now became too much work and is green and filling my yard with mosquettos!

I like the idea that you might get a noice that says you need to dip into the beer and booze budget and put the gutters back up, and buy gas for the lawnmower! And no.... I don't think your Halloween and Christmas lights look good in freakin JULY!! Get the faded Santa inside already!

But isn't it scary living way out there in the boonies BTBW ..... don't know if I could handle living out that far with all them country folk with all the “help your neighbor” and “mind your own business”.....LOL
speaking of which do you want a couple of roosters ? I have 5 of the darn things and they are killing my chickens ...if you want one just say so if not I am going to fly all but one of them.

HOA's are supposed to enforce codes that enhance the life of it's community as such they are given certain rights under law to enforce those codes. As for opting out, that's not a possibility from my knowledge. I don't think I ever heard of anyone going to court and winning a petition to dissolve a membership with an HOA in Florida.

I think that you need to take a more active part in your HOA meetings, read your flyers on upcoming amendments to the codes and regulations set by your HOA. Also reread the agreement you entered into with your HOA to see if there are any rights you're not aware of.

I know last year they tightened up the laws that regulate HOA's and the committees there in. At the same time they didn't change anything that would allow community members to opt out of those agreements. City Governments likes HOA's because it takes a lot of the stress off of them with regards to maintenance and upkeep of these communities. As such if we didn't have HOA's we would have higher property taxes to offset the cost of our city and county governments having to take over operations of these communities.

I don't agree with Abunai with regards to regulating house colors etc. I choose to not live in a community with an HOA just because they are so homogenized and bland. I like to see different architecture and even colors. It's a show of individuality. Also most if not all communities have ordinances to prohibit a lot of what Abunai complained against. FloridaBrit, the good news is after thirty years your deeds expire, unless by majority vote, you reinstate them. Abunai makes some very good points. Originally intentions where most likely good as well, but then a problem or two reared their ugly heads : lawyers and their interpertations ! No matter how screwed up the situation is, when a select few profit handsomely, do you see any reason for them to make any change ? The words : conflict of intrest, come to mind. But I quess that only applies to the non-legal civilian !

...yea they are good size and mean as they can be ! I will try to catch them but I may have to take the easy way out (just eat around the buck shot)
But back to the post , if you hate your HOA but love your house you need to get active ...first all HOA's have a charter this is a binding set of rules that they must abide by , get a copy and read it before moving forward your next steps will be based on the rules of the charter...you may be able to just write a petition and get signatures from residents but in most cases you will need to run for a seat on the board to have any effect...it is a lot of work

im wondering when HOAs are going to be challeneged nowadays that people want to use rotary clothes lines (like the rest of the world) and cut out the dryer -saving 10 percent of your energy bill a month.\lets face it-our climate is perfect for letting the warm sun dry your clothes naturally.

I like family time,good friends,Music, Nature, Soccer. I am a supporter of Manchester United F.C. I appreciate the fine female form in all races ! I dont like sexism,racism, any kind of 'ism ! I want to drive an Aston Martin Vanquish but at this moment drive a car a lot less expensive !! I like flying with Microsoft flight simulator, and online gaming with Half Life. I love living here -could it be better?-sure but it could also be a lot worse. I get homesick every time the soccer season starts ! Thats all folks ! :-)
